OSHA vs NFPA: Which Fire Watch Rules Apply to You?

One is federal law about employers. The other is a library of consensus standards about buildings and systems. Most real fire watches answer to both at once.
OSHA regulations are federal law binding employers, enforced by citation. NFPA standards are consensus documents that become enforceable where a government adopts them, which is how they reach buildings through state and local fire codes. They meet on the ground: a welder’s employer owes OSHA a fire watcher while the building owner owes the fire marshal an NFPA-based impairment program, and one properly staffed watch can serve both.
Two different systems
OSHA is the Occupational Safety and Health Administration: a federal agency writing regulations in 29 CFR, applying to employers, enforced with inspections and citations. NFPA is the National Fire Protection Association: a standards body whose documents, NFPA 25, 72, 101 and the rest, have no force of their own until a jurisdiction or a regulator adopts them. Florida adopts NFPA codes statewide; CMS adopts them for healthcare; OSHA itself references NFPA standards in places.

Where they meet
The same event usually touches both. Hot work: OSHA requires the fire watcher for the workers; the adopted fire code layers its own permit discipline on top, built on or parallel to NFPA 51B. A sprinkler outage: NFPA 25 defines the impairment program the marshal enforces; OSHA’s fixed-system rules, where they apply, require notification and temporary precautions through the same outage. The requirements point at different duty-holders and arrive at the same guard.

When they differ

The practical answer
Hot work or worker exposure: OSHA duties attach to the employer.
System impairment or occupancy issue: the adopted code and the marshal govern.
One watch can serve both sets of duties when it meets each of them. Verify against both lists, not just the stricter number.
OSHA vs NFPA questions
Only where adopted, and OSHA’s own welding rules carry similar requirements as actual federal law. On most sites the practical program follows NFPA 51B and satisfies OSHA on the way.
Not directly for the standard itself, but OSHA can cite its own parallel rule, and unadopted standards can appear as evidence in general duty cases, which carry their own elements. Treating the standard as your working floor is the safe posture, not a legal mandate.
