You are standing beside an industrial tank while a seized bolt refuses to move. The torch is ten feet away. Production is waiting.
That is the moment a repair stops being routine. A recent New York marine casualty shows why. Federal investigators found that hot work above a sludge tank ignited flammable gas and caused a fatal explosion. The lesson is not limited to vessels. Any tank, pit, concealed space, or process area can hold fuel your eyes cannot see.
What the Rule Requires Before Hot Work Starts
Hot work includes welding, cutting, brazing, grinding, torch heating, and other work that produces flame, heat, or sparks. The permit is not paperwork after the fact. It is the decision point before ignition sources enter the area.
OSHA’s construction hot-work rule requires movable fire hazards to be removed or protected. Suitable extinguishing equipment must be ready for immediate use. When normal precautions are not enough, additional personnel must guard against fire during the work and afterward.
The same rule addresses containers and hollow structures that held flammable or toxic material. Before heat is applied, they must be cleaned, ventilated, and tested, or filled with water where the rule allows. An opening must also relieve pressure created by heating.
NFPA 51B is another common hot-work framework. Its use depends on the standard’s edition, local adoption, the occupancy, and the authority having jurisdiction. Your fire marshal, port authority, safety officer, insurer, or permit program may impose stricter controls. Treat the local permit as the floor for the job, not an obstacle to work around.
A New York Explosion Shows the Hidden-Fuel Problem
WorkBoat reported on July 31 that the National Transportation Safety Board traced a 2025 sludge-vessel explosion in New York City to unapproved hot work. Investigators found that a heating torch was used above a cargo tank containing flammable methane gas. The ignition overpressurized the tank.
The details matter because the job looked small. Rusted bolts had broken while workers removed fittings. A torch was used to loosen a remaining bolt. The tank opening allowed flammable gas to reach the work area. Seconds later, the gas ignited.
This was not a fire-watch failure alone. A guard cannot make an unsafe atmosphere safe by standing nearby. The first controls are authorization, isolation, cleaning, ventilation, atmospheric testing, and choosing a cold-work method when possible. A hot work fire watch supports those controls. It never replaces them.
Property managers face similar conditions in boiler rooms, trash systems, wastewater areas, commercial kitchens, manufacturing lines, and roof work. A tank marked empty may still contain vapor. A spark can travel through a wall opening. Heat can conduct to the opposite side of a partition. Dust, residue, insulation, or roofing material can ignite after the crew packs up.
When Fire Watch Requirements Apply
The trigger comes from the hazard assessment, permit program, applicable rule, and the AHJ. OSHA requires additional personnel when normal fire-prevention precautions are not sufficient. Your permit may require a dedicated watch when combustibles remain nearby, sparks can reach concealed areas, or heat transfers through an assembly.
A watch may also be required when automatic fire protection is impaired during the work. If sprinklers, alarms, detection, or suppression equipment are shut down, you now have two separate problems. Follow the impairment procedure and notify the required parties. The AHJ decides whether patrol coverage is acceptable and how long it must continue.
Do not use a welder as the fire watch while that person is actively welding. The watch must remain focused on changing conditions, flying sparks, smoke, and hazards outside the worker’s view. Your written permit should identify the watch by name and define the protected area.
What the Guard Actually Does
The guard starts before the first arc or flame. The patrol area is checked for combustibles, openings, penetrations, floor levels, and adjacent spaces. Extinguishers must be suitable, accessible, and ready. Exit routes stay clear.
During the job, the guard watches the work and the places sparks or heat can reach. That can include the opposite side of a wall, the floor below, a ceiling void, or a roof edge. Conditions are recorded on the permit or fire watch service log, including start time, patrol observations, hazards corrected, and communications.
If smoke, flame, unusual odor, rising temperature, or unsafe vapor readings appear, the response is immediate. Stop the work. Warn people in danger. Activate the alarm or emergency notification procedure. Call the fire department as the site plan directs. Use an extinguisher only on an incipient-stage fire when trained and when escape remains open.
The watch continues after hot work for the period required by the permit, code, and AHJ. That time is not guessed at the end of the shift. It is established before work starts. Smoldering insulation and concealed wood do not care that the contractor’s truck is leaving.

Start with the permit. Identify the person who can authorize hot work and the person who can stop it. Confirm the exact work area, equipment, expected duration, and fire-protection status.
Then challenge the fuel path. Ask what the tank, line, pit, or room contained. Require documented isolation, cleaning, ventilation, and atmospheric testing where applicable. If the crew cannot prove the space is safe, postpone the torch and use a cold method.
Walk both sides of the work area. Check above and below. Remove combustibles instead of covering them when practical. Protect what cannot move. Confirm that extinguishers, alarms, radios, and emergency contacts work before the permit is signed.
